Warranty

 

Masterack warrants it’s manufactured parts and components to be free from defects in material and workmanship as set forth herein. This warranty is nontransferable from the original purchaser (Purchaser) to subsequent owners.

THIS WARRANTY IS MADE AT THE TIME OF RELEASE TO THE ORIGINAL PURCHASER AND IS GIVEN IN LIEU OF ANY AND ALL OTHER EXPRESS OR IMPLIED WARRANTIES (INCLUDES PARTS & SERVICE). THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE EXPRESSLY DISCLAIMED.

Standard, Limited Manufacturing Warranty

The standard, limited warranty includes coverage for defects in structural material and workmanship of Masterack manufactured parts and components provided they are assembled, installed and used with all manufacturer’s provided specifications and instructions. Powder coating is covered against debonding, cracking and peeling for warranty period.

  • The Masterack UPLYFT Ladder Rack products are warrantied for a period of 5 years from the date of receipt or release to the Purchaser.
  • All other Masterack manufactured products are warrantied for a period of 3 years from the date of receipt or release to the Purchaser.

180-Day Installation Warranty

Where Masterack is charged with installing product(s) not manufactured by Masterack on behalf of the Purchaser, Masterack provides a 180-day warranty to cover the installation workmanship of these components. Masterack makes no warranty on any part, accessory, or goods manufactured by others. The Purchaser is responsible for contacting the original equipment manufacturer should there be any defects or issues with the component itself.

Missing Components

Should there be any components missing from material shipments, the original purchaser has a 10-day period starting from the receipt of goods to report the missing items to Masterack as is outlined in the General Sales Terms & Conditions, Section 7. Warranty coverage for missing components will not extend beyond the 10-day inspection period.

Not Covered by Warranty:

  • Failure to follow Masterack recommended maintenance procedures.
  • Deterioration caused by corrosive, hazardous or unsafe cargo.
  • Deterioration or corrosion caused by operations near salt water or salted roads.
  • Defects in chassis and/or power unit, refer to OEM warranty.
  • Defacing, scratches, dents, chips or tears, on any surface not caused by the warrantor.
  • Defect in components not manufactured by Masterack.
  • Deterioration due to normal wear and tear.
  • Removable/replaceable accessories (e.g., cargo control straps and bars)
  • Deterioration due to damage or misuse, abuse, failure to follow recommended maintenance procedures outlined in Owner’s Manual or warning labels, failure to follow weight limits or vehicle limitations.
  • Damage caused by vehicle accidents, acts of nature, including, but not limited to lightning, hurricanes, tornadoes, winds, snow, hail, floods or fire, or other contingencies beyond the control of Masterack.
  • Repairs and/or modifications made under the warranty period without the approval of Masterack.
  • Repairs and/or modifications made after the warranty period
  • Installation or re-installation not performed by Authorized Repair Center.
  • Transportation to and from repair facility to obtain warranty service.
  • Component parts covered by separate supplier warranty agreements.

It shall be Customer’s responsibility to contact Masterack sales or customer service representative at 800-222-8785 and obtain approval and a Masterack Warranty Authorization Number before any repairs are made which are covered by or affect this warranty, to secure Masterack approval. Approval/ Authorization numbers provided by Masterack pursuant to a warranty claim are voided if not used within 30 days of issuance. Masterack shall, at its option, provide a factory or local representative to inspect the equipment prior to issuing such approval. Masterack reserves the right to make changes or improvements to the design or product without thereby obligating itself to make the same changes or improvements upon its product previously manufactured. Masterack warranty is void if Masterack original equipment parts are not used in repairs and/or if the repair was not performed by a Masterack Authorized Repair Center. Without regard to the nature of the claim asserted, Masterack shall not be responsible nor otherwise be held liable for cargo loss, loss of use (including truck rental fees), property damage, other commercial (economic) loss, or other direct, indirect, incidental, consequential, or special damages alleged to have been caused by any product delivered thereunder.

Customer’s sole and exclusive remedy for any claim arising out of (a) breach of contract, (b) any defects in products or workmanship, (c) breach of any warranty hereunder, (d) Masterack negligence in performing hereunder, or (e) any other claim arising hereunder whether in tort, strict liability, or otherwise, shall be limited to the repair or replacement of such products, at Masterack’s option, within the period set forth herein, and shall be deemed waived unless such claim is made in accordance with the following procedures: (1) Customer shall give Masterack written notice of such defect, including a description of product and defect, within thirty (30) days after such defect is, or ought to have been, discovered; (2) if and after Masterack requests its return for inspection and or replacement and such product is returned to Masterack within ten (10) days with freight prepaid by the customer; and (3) customer complies with all additional requests for information within a thirty (30) day period of the request date. Upon receipt of proper notice from Customer and return to Masterack (if requested, as provided hereunder), Masterack shall be obligated to repair or replace such product only if, after Masterack’s inspection, such product is found to Masterack’s satisfaction (a) to be defective, (b) not to have been manufactured in a workmanlike manner, or (c) not to have been manufactured in accordance with written specification or drawing, if any, supplied by Customer to Masterack. Customer shall have no other equitable or other remedy at law available to it.
